General Terms and Conditions of Sale (GTC)

These General Terms and Conditions of Sale (GTC) govern sales made through the online store intended for private consumers (hereinafter "the Customer").

By placing an order on the website, the Customer acknowledges having read and unreservedly accepted these GTC, in accordance with the Belgian Code of Economic Law (Book VI) and European Directive 2011/83/EU on consumer rights.

2. Products

GUST CARE markets shampoos for dogs, formulated without fragrance, designed to respect skin, skin balance, and animal well-being, regardless of the animal's size or coat type.

The products are manufactured and packaged in Belgium, using carefully selected natural ingredients. They are available in 500 mL and 1 L formats.

Period After Opening (PAO): 12 months after first use.

The products offered are not veterinary medicines and are in no way a substitute for a veterinary diagnosis, advice, or treatment.

Photographs, visuals, and descriptions are provided for informational purposes only and are not contractual.

GUST CARE reserves the right to modify the assortment, formulations, packaging, or characteristics of the products at any time, in compliance with current regulations.

3. Price

Prices displayed on the website are indicated in euros (€), all taxes included (TTC), including 21% Belgian VAT.

Delivery costs are not included in the product price and are specified separately before final order validation.

GUST CARE reserves the right to modify its prices at any time, but products will be invoiced based on the rates in effect at the time the order is validated.

4. Orders

The ordering process includes the following steps:

  • Selection of product(s) and adding to cart
  • Checking cart contents
  • Entering delivery and billing information
  • Selecting the delivery method
  • Choosing the payment method and validating payment
  • Order confirmation by email

The order becomes final only after payment validation and email confirmation, in accordance with Article VI.45 of the Code of Economic Law.

GUST CARE reserves the right to refuse or cancel any order in case of:

  • suspicion of fraud;
  • incomplete or incorrect information;
  • prior dispute with the Customer;
  • payment issue.

5. Payment

Payment is due immediately upon order.

Payments can be made via the secure payment methods offered on the website, including:

  • Credit card (Visa, Mastercard)
  • Bancontact
  • Any other payment method offered on the website

Payment is secure and processed by a PCI-DSS certified payment service provider. Banking data is never stored by GUST CARE.

6. Delivery

Orders are shipped to the address provided by the Customer during the order process.

Delivery times are indicative:

  • Belgium: 2 to 5 business days
  • European Union: 5 to 10 business days

A tracking number is communicated to the Customer when available.

In accordance with Article VI.43, § 2 of the Code of Economic Law, in the absence of delivery within 30 days of the order, the Customer may terminate the contract and obtain a full refund of the sums paid.

The transfer of risks occurs at the time of physical possession of the goods by the Customer or a third party designated by the Customer, other than the carrier (Article VI.44 of the Code of Economic Law).

The Customer is required to check the condition of the package upon receipt. In case of a damaged or opened package, the Customer must contact GUST CARE within 48 hours of receipt.

7. Right of Withdrawal

In accordance with Articles VI.47 to VI.53 of the Code of Economic Law (transposing Directive 2011/83/EU), the Customer has a period of 14 calendar days from receipt of the order to exercise their right of withdrawal, without having to give reasons for their decision and without penalty.

To exercise this right, the Customer must send an unambiguous declaration by email to contact@gustcare.com or by mail to:

The Customer may use the standard withdrawal form (Annex 2 of Book VI of the Code of Economic Law) but this is not mandatory.

To be eligible for a return:

  • the product must be unused;
  • unopened, in its original packaging;
  • in perfect condition;
  • accompanied by proof of purchase.

Opened or unsealed products after delivery cannot be returned for reasons of hygiene and health protection, in accordance with Article VI.53, 5° of the Code of Economic Law. This exclusion is brought to the consumer's attention before placing the order, in accordance with the pre-contractual information obligation (Article VI.45, § 1, 11°).

Return shipping costs are borne by the Customer, except in the event of an error attributable to GUST CARE.

Refund:

In accordance with Article VI.50, § 2 of the Code of Economic Law:

  • Full refund (product + initial standard delivery costs) is made within a maximum of 14 days from notification of withdrawal
  • Refund may be deferred until receipt of the returned product or proof of its shipment (whichever comes first)
  • Refund is made via the same payment method as used for the order, unless otherwise agreed

If the Customer chose a more expensive delivery method than the standard method, only the cost of the standard method is refunded.

8. Defective Products or Order Error

In case of receiving a defective or incorrect product, the Customer must contact customer service within 48 hours of receipt with:

  • the order number;
  • photos of the product and packaging;
  • a description of the problem.

After validation of the case, GUST CARE will offer, depending on the situation:

  • a replacement;
  • a refund;
  • a credit note.

In these cases, GUST CARE covers the return shipping costs.

9. Legal Guarantee of Conformity

In accordance with Articles 1649bis to 1649octies of the former Belgian Civil Code (transposing Directive (EU) 2019/771), the Customer benefits from a 2-year legal guarantee of conformity from the delivery of the product.

In case of a defect in conformity found within the first 12 months following delivery, the defect is presumed to have existed at the time of delivery (legal presumption). Beyond 12 months, the Customer must provide proof of the defect.

The Customer may request repair or replacement of the product. If this is impossible or disproportionate, a price reduction or a full refund may be granted.

10. Liability

GUST CARE cannot be held responsible for indirect damages related to the use of the products sold.

Product use must comply with the recommendations on product packaging or descriptions.

GUST CARE cannot be held responsible for any delay or non-performance resulting from a case of force majeure, including but not limited to: strikes, natural disasters, fires, floods, health crises, supply disruptions, or logistical disruptions.

11. Intellectual Property

All content present on the GUST CARE website (texts, images, logos, visuals, videos, design, graphic elements) is protected by intellectual property laws.

Any reproduction or unauthorized use is strictly prohibited without prior written authorization from Ameritex SRL.

12. Personal Data

Personal data is processed in accordance with the Privacy Policy available on the website.

In accordance with Book XVI of the Code of Economic Law, in case of a dispute not resolved amicably, the Customer may resort to:

14. Applicable Law and Competent Jurisdiction

These GTC are subject to Belgian law.

In case of a dispute, an amicable solution will be sought before any legal action.

Any dispute relating to the interpretation or execution of these GTC falls under the exclusive jurisdiction of the courts of the judicial district of Ameritex SRL's registered office, without prejudice to the consumer's right to bring proceedings before the court of their domicile in accordance with Regulation (EU) No 1215/2012 (Brussels I recast).

15. Modifications

GUST CARE reserves the right to modify these GTC at any time. The applicable GTC are those in force at the time of the order.
